RubiPic Terms of Use

1. General Provisions

These Terms of Use ("Terms") set out the rules for using the RubiPic mobile app ("the App"), made available by Hubert Przychodniak ("the Developer", "we") through the Apple App Store and Google Play. Downloading or using the App means you accept these Terms.

2. Description of the Service

The App lets you turn your photos into graphic mosaic patterns that simulate an arrangement made of colored dice and 3×3 puzzle cubes ("puzzle cube"). The result is generated exclusively locally, on your device.

The App is not affiliated with, sponsored by, or authorized by any manufacturer of physical dice or 3×3 puzzle cubes, including Rubik's Brand Ltd. Any references to popular 3×3 puzzle cube types are purely descriptive and are meant to illustrate the visual effect you can achieve, not to suggest any partnership with the owners of the relevant trademarks.

3. License

We grant you a non-exclusive, non-transferable license to use the App on iOS/Android devices that you own or control, for personal use only, in accordance with the terms of the store (Apple App Store / Google Play) from which the App was downloaded.

4. In-App Purchases

The App offers a one-time, permanent purchase that unlocks full functionality (a "lifetime unlock"). The purchase is processed and billed exclusively by the Apple App Store or Google Play, in accordance with their own payment terms.

Refunds should be requested directly from Apple or Google, according to their own procedures — the Developer does not process payments directly.

The purchase can be restored on another device linked to the same Apple/Google account using the "Restore purchases" feature.

5. Intellectual Property

Photos you upload remain your exclusive property — the Developer claims no rights to them and has no access to them.

The App's code, design, logo, and name are the property of the Developer and are protected by copyright. Copying, decompiling, or reverse-engineering the App's source code is prohibited, except to the extent permitted by mandatory applicable law.

6. User Obligations

You agree to use the App in accordance with the law and these Terms, and in particular not to use it to process content that is unlawful, offensive, or that infringes the rights of third parties.

7. No Warranty and Limitation of Liability

The App is provided "AS IS", without any warranties, express or implied. To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, or consequential damages arising from the use of the App.

The above does not exclude any consumer rights you are entitled to under the mandatory laws of your country of residence.

8. Apple's Minimum Terms (Applies to iOS Users)

This section sets out the minimum license terms required by Apple Inc. for apps distributed through the App Store:

  • This license agreement is entered into solely between you and the Developer, not with Apple — Apple is not responsible for the App or its content.
  • The license is limited to use on Apple-branded devices that you own or control, in accordance with the App Store's Usage Rules.
  • The Developer, not Apple, is solely responsible for providing any maintenance and support for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you, if any — this is the sole warranty Apple will be responsible for, to the maximum extent permitted by law.
  • The Developer, not Apple, is solely responsible for addressing any claims by you or any third party relating to the App, including but not limited to product liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection law.
  • In the event of any third-party claim that the App infringes their intellectual property rights, the Developer, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  • You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or listed on any U.S. Government list of prohibited or restricted parties.
  • Any questions, complaints, or claims relating to the App should be directed to the Developer at the address given in section 11.
  • Apple and Apple's subsidiaries are third-party beneficiaries of this agreement and, upon your acceptance, will have the right to enforce it against you.

9. Complaints

Complaints about how the App works (not related to payments, which are handled by Apple/Google) can be sent to the address given in section 11. We will respond within 14 business days.

10. Governing Law

These Terms are governed by the law of the Republic of Poland, without prejudice to any mandatory consumer-protection provisions of the law of your country of residence.
